End-User License Agreement (EULA) of the Arkenforge Toolkit

 

This End-User License Agreement (“EULA”) is a legal agreement between you and Arkenforge

 

This EULA agreement governs your acquisition and use of our Arkenforge Toolkit software (“Software”) directly from Arkenforge or indirectly through a Arkenforge authorized reseller or distributor (a “Reseller”).

Please read this EULA agreement carefully before completing the installation process and using the Arkenforge Toolkit software. It provides a license to use the Arkenforge Toolkit software and contains warranty information and liability disclaimers.

 

If you register for a free trial of the Arkenforge Toolkit software, or any other promotional or otherwise alternative means for acquiring the Arkenforge Toolkit, this EULA agreement will also govern that copy of the software. By clicking “accept” or installing and/or using the Arkenforge Toolkit software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this EULA agreement.

 

If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software, and you must not accept this EULA agreement.

 

This EULA agreement shall apply only to the Software supplied by Arkenforge herewith regardless of whether other software is referred to or described herein. The terms also apply to any Arkenforge updates, supplements, Internet-based services, and support services for the Software, unless other terms accompany those items on delivery. If so, those terms apply.

 

License Grant Permissions

Arkenforge hereby grants you a personal, non-transferable, non-exclusive licence to use the Arkenforge Toolkit software on your devices in accordance with the terms of this EULA agreement.

You are permitted to load the Arkenforge Toolkit software (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the Arkenforge Toolkit software.

 

Unless stated otherwise, you are not permitted to:

 

A – Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software nor permit the whole or any part of the Software to be combined with or become incorporated in any other software, nor decompile, disassemble or reverse engineer the Software or attempt to do any such things with exemption to content.

B – Reproduce, copy, distribute, resell individual assets within the Software

C – Display or advertise the Software, or any variation on use within the Software, without credit displayed as follows: “Arkenforge, Arkenforge Toolkit”. It must be at least font size 11 in a clear and concise font found on the same page as the displayed or advertised content. Proximity to the displayed or advertised content must be clear to determine an associated link to the credit and the displayed or advertised content. Arkenforge will be the authority on determining whether credit is sufficiently given. Also applies to physical advertisement of the Software.

D – Use the Export function to Export any content that is not owned by Arkenforge or one of its partners and doesn’t have a commercial license to be used or altered by third parties.

E – Allow any third party to use the Software with the intention of selling individual assets unless permitted by Arkenforge.

F – Use the Software with the intention of harming another individual or company, physically or emotionally, or in any way Arkenforge deem a misuse of the Software.

G – Use the Software in any way which breaches any applicable local, national or international law.

H – Use the Software for any purpose that Arkenforge considers is a breach of this EULA agreement.

 

Specific Permissions: Maps and map assets

Those permitted with a legitimate License Grant are free to use the Cartographer module of the Arkenforge Toolkit in the following ways:

– Display, advertise and share maps created by the Software for non-commercial use.

– Display, advertise and share maps created by the Software for commercial use with no third party as long as credit is given as described in License Grant Permission C. Maps that contain intellectual property not owned by Arkenforge or any entity that has an agreement with Arkenforge, are susceptible to the EULA of said intellectual property.

– Display, advertise and share maps created by the Software for commercial use by a third party company or software as long as credit is given as described in License Grant Permission C.

Maps that contain intellectual property not owned by Arkenforge or any entity that has an agreement with Arkenforge, are suseptable to the EULA of said intellectual property.

Unless stated otherwise, all License Grant Permissions apply.

 

Intellectual Property

Arkenforge owns all intellectual property used in the construction and function of the Arkenforge Toolkit Software.

All partners of Arkenforge retain ownership of their intellectual property that may be found within the Software with permissions discussed and permitted individually for each entity involved.

All individual assets within the Arkenforge Toolkit is considered the intellectual property of Arkenforge.

Licensed users have intellectual property of the exact combination of assets, settings and all legal changes made through the Software once it has Exported.

Licensed users that utilise the Export function using content that is the intellectual property of an entity other than Arkenforge or its partners, are susceptible to the EULA of the original owner of said property, Arkenforge is not responsible for the use of said property.

Content imported to the Software that is not owned by Arkenforge retains its original intellectual property owner unless ownership is passed by the previous owner. The intellectual property extends to but does not proceed said intellectual property.

 

Termination

This EULA agreement is effective from the date you first use the Software and shall continue until terminated. You may terminate it at any time upon written notice to Arkenforge.

It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.

 

Governing Law

This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of Australia.
